Justice Department formally charges Apple, big five publishers in e-book price fixing case (update)

The Justice Department has formally decided to sue Apple, Hachette, HarperCollins, Macmillian, Penguin and Simon & Schuster over alleged e-book price-rigging. Apple and Macmillian have already denied any wrongdoing, saying that the agreements were enhancing competition in an industry previously dominated by Amazon. The case centers around a deal to switch to agency pricing, where the vendor takes a 30 percent cut of each sale rather than the wholesale model which allows stores to sell books at rock-bottom prices. It was previously believed that the publishers had cut back-room deals with the Government agency after bowing to pressure to withdraw Cupertino's "favored nation" status. If successful, the DoJ will allow Amazon and Barnes and Noble amongst others to return to the wholesale model to sell best-sellers at a loss, something that the big five are desperate to avoid, and will look to fight the battle in court.

Update 2: Bloomberg is now reporting that Simon & Schuster, Lagardère SCA's Hachette Book Group and HarperCollins have settled with the DoJ over unspecified terms. Hasty!

Expand your knowledge on Dr. Strangeloop ? Los Angeles based visual artist and content curator for the mind-expanding media channel of Future Cinema pieces. What inspired the creation of DMTV? I was putting together an on-going series of Shorts called the Future Cinema Series, they played as interludes between acts at the Brainfeeder Sessions in LA. This was a series we were putting together in the Downtown Independent movie theatre. I hit up some of my favorite contemporary motion-graphics designers / media-makers and to my surprise we were able to get a lot of these incredible films from around the world together to screen for LA audiences. I?m a huge fan of cinema, and what I guess I?d call New-Cinema or Future-Cinema, a definite genre that I can identify online ? almost a whole category of new shorts born from tech-savvy graphics designers stretching the limits of their minds, dabbling
in the hyper-real possibilities of motion graphics, the blurry haze between our sci-fi and our contemporary world, invisible worlds within our world which can be expressed in computer models. For me, I just put a banner on a lot of the things and call them Future-Cinema. DMTV, while also being a call for Mind-Expanding media, is really a collection of Shorts which I see as a part of a genre of cinema which is individuating itself from the broad aesthetics of the field of Motion Graphics. Brilliant artists like Scott Pagano, J.P. Frenay, Semiconductor, exemplify this world for me.

Have you found any particular ways the worlds of audio and visual overlap? They always overlap, and it is more and more evident in our era. All music can be interpreted as visual data and all visions can be interpreted as musical patterns. In a contemporary context, its all code which can be cut-up, transposed, re-defined. For me, different media have no exclusivity, in my mind they get all wrapped up with one another, and inspire one another, a song inspires a vision, a vision makes me think of a song ? sometimes I have this very romantic idea that we?re all synesthetic but have forgotten how to perceive the world in a holistic manner. I?m curious if I can train myself to be more synesthetic.

What has been the most challenging project you have had to work on in your career? Developing content for Skrillex, and working with a much larger team, has been a great challenge. Certainly some of the most technically demanding and rewarding projects I?ve worked on has been with the Skrillex ? with the Cell, his projection mapping / motion capture / stage show ? it was like working with the most sophisticated visual tools that exists, but inevitably tools that were being updated and designed as we?re going on the road with them! Phil Reyneri, one of the genius touch-designers on the team, was creating the interface for the system so that I could fly on it, updating it as we traveled through Europe to incorporate the latest features being developed. I love the whole Skrillex crew because they continually push the envelope and I get to rise to meet the challenges of wholly new set-ups that have never been executed before. They?re not fucking around, they wanna bring the shows to a whole-other, basically sci-fi, level ? which is great to be a part of.

Who would be your dream artist to work with? I?m working with some of them for sure Though I?d love to work with Aphex Twin, Bjork, Sigur Ros. Sigur Ros makes such beautiful music. It would be incredible to design a show for their sounds. There is so many extraordinary artists out there, I feel like I always get to work with the people I?m supposed to work with ? I feel blessed.

Who/what was your biggest artistic influence growing up? I always loved the Visionary arts, work inspired by mystical states. Alex Grey, Leigh McCloskey, Ernst Fuchs ? its hard to pinpoint one person, visual artist, film-maker, musician. I?ve always been curious about the aesthetics of other dimensions, how can you communicate things through art that you experience, but have little or no cultural analogue. Seemingly alien things that may be a deep part of our collective reality, but things we?ve lost touch with. I?ve always liked art where I feel that mapping process going on, where I feel the invisible showing itself, and something from beyond culture arriving into our minds at the right moment.

What/who is on your radar right now? THEO ELSWORTH // artist behind Flying Lotus?s ?Pattern Grid World? album, made an incredible book called Capacity ? highly recommended.

Rough terrain can channel a tornado's damaging winds, new research suggests

ScienceDaily (Apr. 9, 2012) ? Christopher Karstens was on the ground studying the damage caused by the deadly April 27, 2011, tornado that hit Tuscaloosa and Birmingham, Ala.

It was just a week after the tornado. He was between the two cities, in the rough country of the southern Appalachians about 20 miles northeast of Tuscaloosa. He said it's terrain that's "beyond hilly." It's covered by dense forest and clogged by high brush that's tough to walk through. A hike of about 100 yards sometimes took as long as 45 minutes.

It was a perfect place for Karstens -- a doctoral student from Atlantic who's studying under the direction of Bill Gallus, a professor of geological and atmospheric sciences -- to study the effects of complex terrain on the structure of a tornado.

The study is part of a larger Iowa State research program led by Partha Sarkar, a professor of aerospace engineering and director of the university's Wind Simulation and Testing Laboratory. The lab includes several conventional wind tunnels and a Tornado/Microburst Simulator that has been fully functional since 2005. The Tornado/Microburst Simulator has helped researchers attract about $2.3 million from the National Oceanic and Atmospheric Administration and $580,000 from the National Science Foundation to study the impacts of tornado and microburst winds near the ground and their effects on buildings and other structures. One goal is to develop innovative ways to make structures, particularly low-rise buildings, stand up to tornadoes, hurricanes, gust fronts and microbursts from thunderstorms.

Iowa State's tornado research teams have included Sarkar; Gallus; Hui Hu and Vinay Dayal, associate professors of aerospace engineering; Fred Haan, an associate professor of mechanical engineering at the Rose-Hulman Institute of Technology in Terre Haute, Ind., and former aerospace engineering faculty member at Iowa State; Sri Sritharan, professor of civil, construction and environmental engineering; and Gene Takle, professor of agronomy and geological and atmospheric sciences.

"We've learned a lot in terms of the distribution of wind and in terms of the interaction of wind with structures and terrain," said Sarkar.

Sarkar said the researchers have found, for example, that when a tornado blows over rough terrain -- forests or densely built cities -- the structure of the tornado changes. The swirl and maximum rotational speed of the tornado decrease and the vortex spins tighter with a smaller core.

Karstens took that study further by looking at what happens to a tornado when it hits complex terrain such as cliffs, slopes and valleys. That's why Karstens joined other researchers studying the damage caused by the Tuscaloosa-Birmingham tornado.

The researchers looked at the damage to homes and buildings in the cities -- part of their work to develop structures that can withstand high winds. Then Karstens headed for the hills to study the damage there.

He hiked to the storm path and noted damage on the ground and in the trees. He looked for signs that the terrain had disrupted the tornado as it moved up and down the steep slopes. He hiked to the top of valleys so he could take pictures of the damage below.

Back in Ames, he also studied aerial photos of the storm damage. That's when he noticed that trees along valleys far from the tornado path were damaged by high winds.

Karstens returned to the area last January for a second and closer look at specific locations he had identified. He looked at how the damage changed as the storm moved up and over the low mountains. He studied how root and soil conditions could have influenced the storm damage. And he explored side valleys perpendicular and to the left of the tornado's path to see the storm damage he noticed on the aerial photographs.

"It was very beneficial to go," Karstens said. "By physically observing the damage I could identify the situation, use some intuition and interpret what happened. That can lead to new ideas and thoughts."

One thought he took back to campus is that the perpendicular valleys provided a channel for the high winds and kept them going far from the actual tornado.

To test the theory, Karstens built a 32-foot by 20-foot 3-D foam replica of a 2-mile by 3-mile section of the same Alabama countryside he explored on foot. Then he ran Iowa State's Tornado/Microburst Simulator over the model terrain, taking wind readings inside the various valleys.

Karstens, who has accepted a research job at the Cooperative Institute for Mesoscale Meteorological Studies in Norman, Okla., is still analyzing the data. But he thinks he's onto something new.

"For meteorology, this can add another piece to the puzzle," he said. "It can help us understand the near-surface flow of winds in tornadoes."

But in a nutshell, NaNoWriMo stands for National Novel Writing Month in which you must write 50000 of what normally turns out to be trash unless you're not me in the 30 days and 30 nights of November.

But it's AFTER NaNo (even shorter form of National Novel Writing Month) that I want to rant talk about.

By the end of November 30, 2011, I had 50000-ish words sitting on my hard drive. They called to me, "Come fix us, we promise it will be easy this time. It won't be anything like 2010, when you didn't get anywhere because you had never even finished a story before, nevermind written a whole novel."

Well, those little sirens were somewhat right. It was still hard but I actually got somewhere- am still getting somewhere- because I attacked the monstrosity differently, er, I looked at it differently.

My revision process went something like this.

Cry
Write rough outline
Delete unnecessary bits
Read
Write what parts of plot need to be tinkered with
Fix parts of plot that need to be tinkered with

Add extra bits while separating Monstrosity into chapters (I used Scrivener which made this easy)

Air on the G String, eh? To bring Bach down to my level, it's Morgan Freeman walking through the LA Library in Seven. It's Jamie Foxx seeking a little baroque refuge from the rest of the ungrateful world in Collateral. And now, it's Marie, trying out for an orchestra gig in Rhythm Thief and the Emperor's Treasure. Air on the G String's a truly great piece of music regardless of what you associate it with, of course, but the thought that a lot of kids are going to get their introduction to it by means Sega's exquisite and wonderfully quirky rhythm-action game is still a lovely thing to consider.

And Air on the G String is only one of The Emperor's Treasure's many fine elements. Sega's latest will teach you the French for "woof" - it's "woeuf", apparently, although that may be wishful thinking on the developers' part - and it will give you a decent working knowledge of downtown Paris, albeit one that largely focuses on the major landmarks. More importantly, however, it will make you stupidly happy for almost the entire length of its campaign. This isn't a long game by any means, but I've been playing it on and off over the course of the last week or so, and every time I go to pick the 3DS up I find myself smiling a smile that I normally only reserve for pudding or the arrival of cheques.

At the heart of the game is Raphael. By day, he's a slightly Harry Potterish student, by the looks of it, who lives in an apartment in Paris with his dog Fondue and a mysterious basement filled with - well, you'll find all of that out for yourself at some point. By night, however, he transforms into Phantom R, a sharp-suited superhero cat burglar with a thing for musical crimes.

Phantom R's a weird sort of character on paper - when you describe his main attributes, it's a little too easy to make him sound like a gymnastic Michael Buble with a penchant for hopping around on rooftops with a Cezanne under his arm, but it's a testament to The Emperor's Treasure's easy, sweet-natured style, that you buy into him completely, just as you buy Raphael's ongoing search for his missing art forger father, and the surprisingly busy plot that unfolds from that single point.

It's a bit like a Dan Brown novel at times, but with a dreamy orphan violinist sidekick named Marie along for the ride, and an interlude in which you get in a swordfight with Napoleon, who's sensed the time is right for a comeback. I won't spoil any of the major surprises, but I will say that it's a cracker, albeit an oddball cracker.

While Phantom R burgles his way around Paris' hot spots, picking off targets like the Louvre and the Opera and running up against spectral knights and the local police chief's kid, who has a real thing for bludgeoning people with footballs, the game itself plays out like a version of Professor Layton in which the logic puzzles have been removed and then replaced with little rhythm-action mini-games - perhaps by a cat burglar version of Micheal Buble.

It's not a bad trade if you ask me. As you wander the streets of this gloriously reimagined city - watercolour pools of gold around streetlamps, the Sacre Coeur frozen in the orange light of an evening, the Seine rippling beneath a glowing Eiffel Tower - tapping the screen occasionally, Layton-style, to search for coins (you spend them on emergency power-ups) and other collectable doodads, you'll find yourself tasked with a variety of different challenges - none of which, thankfully, involve patterns of matchsticks or those sodding water jugs.

The simplest of your tasks work the way the mechanics of a very simple adventure game might, as you record various sounds to get past various obstacles. A cowardly gendarme is blocking your path, for instance, but audio of a bulldog's growl could scare him off into the night. Beyond that, there are also little pattern-matching sections as you bust open ancient locks and deactivate security terminals, and then you get to the main events: a range of over 40 action sequences in which Phantom R - and occasionally other members of the quirky cast - work their way through extravagant set-pieces by matching beats.

The games repeat their central ideas quite a bit, but for the most part they're a lovely selection of toe-tappers and punchy little hum-alongs and - unlike Layton's brainteasers - they don't stand out like weird non-sequiturs or interrupt the flow of the story. They are harmonious in every sense. Breaking into a police station, for example, you might have to strike coloured sections of the touch-screen to strike the same poses as nearby statues, thereby avoiding a patrolling security guard's flashlight, or you might have to leap from one rooftop to the next, stabbing away at A and B to jump and slide as you make your escape.

Face buttons, shoulder triggers, and even touch-screen swipes are brought in as the game spins from one escapade to the next. The best challenges - like Marie's audition, which sees you conjuring a Bach classic from a simple sawing motion, or a brilliant gun fight-cum-punch-up towards the end of the adventure - have you playing with your ears as much as your eyes as you root out the intricate rhythms you're matching. Sega's designers can leave you feeling distinctly musical at times, while only a few of the challenges stand out as stinkers, and they all involve the gyroscope controls.

The end of the narrative hints at a sequel. Come on, Sega!

The Emperor's Treasure's a pretty easy-going game - its 3D map always tells you where you're headed next, while you can spend coins on power-ups to get you through the trickier rhythm events - but if you want to see absolutely everything the plot has to offer, be warned that you're going to have scour the streets of Paris for every trinket and get an A grade on every challenge.

This is a challenge in itself, as it turns out, because the grading system can be a little flighty, taking you from a top mark down to a pass at the last second on occasion. It isn't too much of a bind, though, since, even when the game's ever so slightly frustrating, it's still a simple pleasure to look at, from the wonderfully gentle 3D effects layered on the environments to the simple, economical anime cut-scenes and the lovely characters. It's even better to listen to, actually, with an eclectic musical taste that means you never quite know what you'll be playing along with next.

Add to that local wireless and download multiplayer and some simple StreetPass integration that sees you filling Paris with fans, and it becomes a game you'll find yourself coming back to even after you've checked off each box and found every last trinket. Stylish, personable and effortlessly idiosyncratic, The Emperor's Treasure doesn't just have rhythm: it also has soul.

I'm a fan of all things digital-- high-definition, wireless, and immediate with their perfect ones and zeroes-- but nooks and crannies of my life will forever remain analog.

It's a 20 year-old VDO piece that's doubtlessly less accurate than a modern digital gauge that delivers readings down to a 1/10th of a PSI-- and yet, I can't do away with its orange on black design, the way the small metal reset button feels under my thumb, and its solid cylindrical metal construction. Put simply, it's a joy to use such a basic, honest tool, even if it doesn't do its job with absolute accuracy.

Some day it will break or fail, and perhaps then I'll move onto a cheap and effective digital gauge. But until that day, my trusty old tire gauge will remind me of those tactile, yet intangible, joys of analog.

MPAA changes 'Bully' rating to PG-13

The filmmaker and studio behind documentary "Bully" on Thursday won their battle to have the movie's rating lowered, allowing kids as young as 13 years-old to see it.

Director Lee Hirsch said he was able to keep a key scene in the anti-bullying film for which he lobbied hard, but he edited out three uses of one certain word to appease the group that rates movies based on language, sex, violence and other content.

"I'm just glad that we held strong. I think this is a great resolution," Hirsch told Reuters about his and distributor The Weinstein Co.'s battle with the Motion Picture Association (MPAA) of America's ratings board.

"We are getting so much interest to see the film, and this makes it much easier for schools to get behind it."

The documentary, which follows five kids and families who have been impacted by bullying, opened in New York and Los Angeles last weekend to a strong $23,000 per screen average at box offices, and the new "PG-13" rating from the MPAA should widen its audience appeal when it expands across the United States on April 13.

Weinstein Co. marketing chief Stephen Bruno said many church groups, school groups and youth organizations had been inquiring about the movie's content, and he hoped that more of them now come to see the film.

The MPAA ranks movies to give audiences an idea of the content within any given film. Initially it had given "Bully" an "R" rating meaning anyone under 17-years-old must be accompanied by an adult when seeing the film.

Their decision was based on the use of one certain curse word that is used six times in the movie. Usage of that particular word more than once results in an "R."

Hirsch and Weinstein initially lobbied the MPAA'S ratings board to change its mind, arguing that it will exclude the very people on whom it would have the most impact, kids. But Hirsch refused to change his movie, and the MPAA refused to budge, too.

Last weekend, it went out unrated, but even that distinction limits a movie's play in some theaters and to some groups.

A compromise was reached when Hirsch agreed to edit out three uses of the particular word, and the MPAA agreed to allow one key scene in which one of the film's subjects is beaten on a school bus and the word is used three times.

"We retained the central scene and all three (words) are intact. The whole scene is intact and that ... was a great victory for me," Hirsch said.
